1. Price Information

1.1 All prices and charges on this website are quoted in UK pounds.. If we discover an error in the price of goods you have ordered we will inform you as soon as possible and give you an option of reconfirming your order at the correct price, or cancelling the order. If we are unable to contact you we will treat the order as cancelled and you will receive a full refund.

1.2 All prices are correct at time of display online, and show prices including and excluding VAT.

1.3 Delivery charges are added during the checkout process, and are dependent on the weight of your goods.

2. Ordering Goods

2. 1 We use Worldpay to provide a secure method of paying for goods online. To order goods, add your items to the basket and proceed through the checkout.

2.2 You must register your delivery and business details with Kestrel Cycle Stands by creating an account in order for us to process your order. This will help you to track and complete your order with us, and make any enquiries to us relating to your order.

2.3 We use secure (SSL) technologies to capture the information you provide and we send your billing address information to our payment provider Worldpay.

2.4 Note that we do not ask for or store your credit card information directly on the www.kestrelcyclestands.co.uk website. This information is supplied to our payment gateway provider Worldpay.

3. Payment

3.1 We must receive payment of the whole of the price for the goods that you order before we can accept your order. Once payment has been received by Kestrel Cycle Stands, we will confirm that your order has been accepted by sending a confirmation email to you at the address provided on your order form.

3.2 You will also receive a confirmation email from Worldpay indicating that a transaction has been made.

3.3 Acceptance of your order brings into existence a legally binding contract between Kestrel Cycle Stands and you the customer.

4. Validation Checks

4.1 Credit and charge card holders may be subject to validation checks and authorisation by the card issuer.

4.2 If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.

4.3 If for any reason your payment is declined, you will be notified via the email address that you supply when making your order.

5. Delivery of Goods

5.1 Due to variable shipping costs, we are unable to process orders online for delivery to certain areas of the UK. We define our areas of delivery as the UK mainland. This area excludes Northern Ireland, the Channel Islands, some areas of the Highlands, and the Isle of Wight.

5.3 We do everything we can to meet the delivery time specified , however occasionally delivery times may be affected by factors beyond our control and cannot be guaranteed. We will inform you if we become aware of an unexpected delay.

5.4 Many of our goods are made to order. Manufacture and delivery times may vary. We will notify you of expected manufacture and delivery times by telephone.

6. Complaints and Queries

7. Cancellation of Contract by you and Unwanted Goods

7.1 If you decide that you do not want any item which we have delivered or which you have ordered then, provided that you notify us in writing of such cancellation or complete our online returns form. You must ensure that any such item is returned to us by you in its original and unused condition (including in its original packaging), along with delivery note (as proof of purchase) within 28 days of delivery. we will exchange it or offer a refund.

7.2 The return carriage cost will be the responsibility of the buyer.

8. Returning Goods

8.1 You should obtain a certificate of postage when returning items

8.2 Once you have notified us that you are cancelling your contract in respect of such goods, any sum debited to us from your credit card will be re-credited to your account (less any cancellation charges) as soon as possible and in any event within 30 days of your order PROVIDED THAT the goods in question are returned by you and received by us in the condition they were in when delivered to you.

9. Faulty Goods and Liability

9.1 If you purchase a product from us which is found to be faulty or is not what you ordered we will at your option supply a replacement product (or the correct product), or arrange for a repair or give you a refund of the purchase price, provided that you notify us in writing within 5 working days of delivery of the goods in question.

9.2 Please return the item with delivery note or other proof of purchase and upon receipt of the product we will examine it. We aim to dispatch a replacement product, arrange a repair or refund your money within 14 days.

9.3 You are advised to return a certificate of posting when returning items by post. If the item is faulty we will re-imburse you the postage or courier costs.

9.4 We can arrange collection by courier, which would be free of charge if the item is faulty or is the incorrect item

9.5 If you do not receive goods ordered by you within 30 days of the date on which you ordered them, we shall have no liability to you unless you notify us in writing at our contact address of the problem within 20 days of the date on which you ordered the goods.

9.6 Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question.

9.7 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.

10 Notices

11 Events beyond our control

11.1 We shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

12 Invalidity

12.1 If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these conditions will not be affected.

13 Privacy

13.1 You acknowledge and agree to be bound by the terms of our privacy policy

14 Third Party Rights

14.1 Except for our affiliates, directors, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act

15 Governing Law

15.1 The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.

16 Entire Agreement

16.1 These terms and conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of our agreement relating to the supply of the goods to you by us. Nothing said by any sales person on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.
